NWMLS Policy

At REPNW, we follow current best practices for real estate media licensing, shaped by ongoing legal developments in Washington and across the United States.

Recent cases, including a 2024 copyright claim involving the misuse of listing photos reposted by third parties and several MLS related disputes over photo ownership, highlight why it is important for professional photographers to maintain clear usage terms. They exist to protect both the photographer and your investment in the property’s media, and to ensure that your photos are not reused without authorization.

Who Owns the Photos

All photographs, videos, and digital media created by REPNW remain the intellectual property of the photographer. This means REPNW retains copyright ownership, but every client receives a broad license for full marketing use including upload and display on the Northwest Multiple Listing Service (NWMLS), brokerage websites, social media, and other promotional channels for the duration of the listing.

 

Print and Publication Use

This license covers print use only when it is for your own marketing purposes, such as flyers, postcards, or direct mail promoting the property or your real estate services. It does not include any print or digital magazine, newspaper, or e-zine publication without prior written consent from REPNW.

Why This Matters

Signing broad perpetual MLS agreements can sometimes allow future agents or brokerages to reuse your home’s photos without hiring the original photographer. Our approach ensures your photos stay compliant within NWMLS for your listing while protecting against unauthorized reuse by other agents after the listing period ends.

Your Rights as a Client

You are fully licensed to use all delivered photos and videos for marketing your current listing through NWMLS and related sites.

You can continue to use the media for your personal portfolio, sold property marketing, and "just listed" or "just sold" promotions.

Future agents or brokerages do not have permission to reuse these images for new listings without written approval from REPNW.
